Can an ex-convict still receive SSI? I was just wondering because of the fact that when my fiancée gets out of prison he's going to need something to help him out financially whether it be SSI or a job, but it's a very difficult task to find somebody who's willing to hire somebody who has been behind bars before.

I don't know the law, but your right, he will have a difficult time finding a job when he gets out. Also, Prison changes a person, so good bad or ugly he may not be the same person when he gets out.

Out of curiosity, I know some state prisons offer education and skills training to help them prepare for release. Do you know if he is in any of those programs?

Ik, I've been warned about that first part before that he might not be the same person and I agree, but I'm sure that above it all that we'll still love each other and that's the most important thing. :) And yes he used to be in this college program but it didn't work out so well so now he's doing some kind of job working in the library. He also has done sewing and is with some kind of church/Bible group so he is keeping busy and holding up as well as can be expected.

He might need to search through a temp agency if he has a hard time finding a job on his own. I'd recommend that before searching answers from SSI. Is he getting out soon?

Thanks for the advice and well it's sooner than it was a few years ago. 2022 is his scheduled release year unless we find any loopholes or anything.

I assume by SSI you are speaking about Social Security? What would be his qualifications for social security? Has he been categorized as disabled by the SS administration? Is he 62+ and applied for SS?

He has Aspbergers. (Sp?)

If he can take advantage of training programs while he is incarcerated, that would seem to be a good thing to do. Even if he doesn't do well, it will show desire, commitment, dependability, and drive to succeed. All of which are important characteristics employers look for.

Even with having Asperger there are social skills he can work on while incarcerated that can prepare him socially for the job market. My husbands nephew has this and is on disability and the meds he takes helps him with social issues. He tries to work, but it's hard for him as he struggles with being around a lot of people. Anxiety and depression are a part of Asperger, but can be controlled with meds. Being very young I'm not sure if he could get SSI, but should qualify for SSD which I am on for my disability. SSI (Social Security Income) and SSD (Social Security Disability). He needs to talk to his doctor and a lawyer about applying for SSD. It actually took me three years after being denied three times before I hired a lawyer who fought for my rights.

Umm,.. just so you know he already had SSI before he was arrested. I'm just not sure whether or not he will be able to get it back that's the issue here. And since having a learning disability I have it too and my worry is that we won't be financially supported enough to be independent and live on our own, get married, and have a family.

Now I am not a lawyer nor do I play one on TV, but I'll tell you one thing I know for sure. All trhat SSI and social security stuff, is based on the individuals working history and the regular payroll deductions that everyone has chipping away at their check...long story short...it can't affect it because he will be an ex convict...He worked for that money and it was HIS money that he paid into it.

They can't just keep it for any reason...he worked for that. Don't let them do that to you. Not something you should worry about. It's his money.

Since his SSI was suspended by him being incarcerated for more than 12 months he will have to reapply for it again when he is released. He will also need his release papers when he goes to apply again. I'm not sure about SSI, but do know if you are on SSD you can work a certain amount of hours a week. You would have to look into that. When the both of you are once again together you can look into government housing after you are married as there are apartments that go by your income.

Really?? Thanks for the info Deb. So he can at least reapply for it, does that mean that he's guaranteed to get it though?

It's no guarantee, but just reapply when he gets out and see what happens. If he was on it before he went to prison I can't see why he could not be reinstated. All he will need is his release papers for proof he is no longer incarcerated.
