consent must include this: legal age, sobriety,being awake,lol. marriage doesn't negate any of that.

Okay we know that is crazy , but men has been doing that for ages by getting girls drunk or giving them date rape drugs. But what I want to know is say for instance a husband has sex with his drunk sleep wife, is that rape ?

If it doesn't include the husband wife relationship then an abusive husband could get around it by giving her a drug (just like in some date rapes) or by a fist in the jaw or a knock over the head.

Wow you don't play around do you. If a husband has to give his own wife a drug or get her drunk to have sex that marriage is in trouble. And yes Deb some men will hit them if they don't comply and take it.

Some of the things that happen are not so easy to imagine, especially not by nice guys.

It is if the wife says it is.
uhm no, it is rape, the wife may not report it but she cant consent while drunk legally, though one has to prove that the defendant was trying to get her drunk to have sex. In military that is rape no matter what. and much of the rape cases are of this nature.(in the army)
 
It use to be lawful all over the world for the husband to take it by force if he had to, and nothing was ever said. He would not even get locked up the cops would not do a darn thing, and this is what I know. And it was that way when I was coming up.

that is why tailhook et all happened and still does. im not sure from a legal history as I don't know where to look. rape isn't new. I don't see that being the case that recently in America.

If you have a normal, consensual relationship, I'd say, 'no'.

I agree because unconscious connotes something much more severe than just being sleepy, or sleepy drunk. If a man's wife is unconscious I would expect him to be thinking about what medical condition caused her to be unconscious, not whether or not he should have sex with her.
 
I think the question is how the bill should be written. Should it included an unconscious spouse? I think it should.
