WOMEN ARE DEFICIENT IN INTELLIGENCE AND RELIGION

.

It’s noteworthy that the status of woman in Islam constitutes no problem. Many verses of the Qur'an and practices of the early Muslims bear witness to the fact that woman is, at least, as vital to life as man is, and that she is not inferior to man in any way. Islam never belittles woman or underestimates her role in the society. Allah has made this clear in the Glorious Qur’an, by stating shining examples of some women for the believers– male and female- to emulate. In this context, the Glorious Qur’an says, (And Allah citeth an example for those who believe: the wife of Pharaoh when she said: My Lord! Build for me a home with thee in the Garden, and deliver me from Pharaoh and his work, and deliver me from evil doing folk; and Mary, daughter of Imran, whose body was chaste, therefor We breathed therein something of Our Spirit. And she put faith in the words of her Lord and His Scriptures, and was of the obedient.) (At-Tahrim 66: 11-12)

Thus, as the regards the point you raised in your question, we’d like to make it clear that the Hadith does not depict a woman as inferior; not at all. As it’s a fact that man has been given a form and nature by Allah which is distinct from that of woman, it’s also a fact that the form and nature of man and woman is complementary. This indicates that the distinction in form and nature must not be equated with an intellectual pre-eminence on the part of man.

Based on this, we'd like to stress that the issue of having a woman’s testimony corroborated by another woman does not imply a sign of gender superiority. One will get this point clear by bearing in mind that shyness is a specific feature of woman as compared to man. In this case, she needs another woman to stand by her side and corroborate the evidence. There is nothing wrong with having a witness’s testimony corroborated by another witness if the statement of the former falls short of being admissible as a conclusive evidence. So the main issue here is how to make justice run its course.

Focusing more on the question in point, we’d like to cite the following Fatwa issued by the late Muslim scholar, Sheikh `Abdul-`Aziz Ibn Baz, the former Mufti of Saudi Arabia:
The Prophet, peace be and blessings upon him, explained that women’s mental deficiency is reflected in their weak memory, the fact that makes Shari`ah stipulate that a woman’s testimony must be corroborated by another woman. Thus, this injunction does not imply woman’s inferiority to man; rather it has more to do with justice than to gender.

As for the shortcoming in religion, this stems from the fact that when menstruating or having post- partum bleeding, women neither pray nor fast, and they do not have to make up for their prayers.

As we know, women have no hand in the obstacles that disrupt their religious performances. This is something divine, which reflects Almighty Allah’s overflowing mercy on them, for it will be extremely hard for a woman to be tasked with religious obligation while she is having menstruation or post-partum bleeding. That’s why she is exempted from fasting or praying, as a sign of mercy on her. Also, they do not make up their prayers. This is because if they were ordered to make up their prayers, it would be extremely hard for them, given that prayers are performed five times a day. Menses may last for a number of days, up to seven or eight or more. Post-partum bleeding lasts for forty days. It’d be definitely hard for women to be obliged to make up the prayers missed while responding to the demands of nature.

So, in the light of the above-mentioned facts, the Hadith does not have any indication of looking down upon women or considering them as inferior, especially when we know that some women excel men in many matters.

Yes, no one can deny the fact that a woman may perform many good deeds and exceed many men in virtue, morality, etc. Islamic history abounds with examples of great women who have made great contribution to the progress of mankind. This is very clear to anyone who is well informed about the status of women during the time of the Prophet, peace and blessings be upon him, and the early generations.

In addition, the Hadith in question does not disqualify women from being narrators of Hadiths, and there is nothing that prevents a woman from being one of Allah’s pious servants, if she is steadfast in her religion even with her being excused from fasting or praying during menstruation or post-partum bleeding.

Prophet Muhammed (PBUH) always stressed the fact that men should treat their women in a fair way and never to use violence in dealing with them. He said:

'Whoever believes in Allah and the Last Day should not harm his neighbors. And I command you to take good care of the women.' (Bukhari)

Even when women misbehave, tolerance and not violence is recommended, as a way to solve the problem. The Prophet (pbuh) said:

'No believing man should hate a believing woman, if he hates one of her manners, he should be satisfied with another.'

The same meaning is repeated in a heavenly advice for husbands through the Qur'an - the holy book of Muslims - that says:
... live with them on a footing of kindness and equity. If ye take a dislike to them it may be that ye dislike a thing, and God brings about through it a great deal of good.

Surah 4 Verse 19

Again, the Prophet (pbuh) stressed this meaning, saying:

'The believers who have the best manners are those who have the most perfect faith. The best amongst you are the best towards their wives.' (Tirmidhi)
criticized
He also criticized those who misbehave towards women saying:

'Many women come to Muhammad's family members to complain about their husbands, those men are not the best amongst you.' (Ibn Magah)

Wife beating in Islam

TEXT FROM THE QURAN, 4:34

RODWELL: "Men are superior to women on account of the qualities with which God has gifted the one above the other, and on account of the outlay they make from their substance for them. Virtuous women are obedient, careful, during the husband's absence, because God has of them been careful. But chide those for whose refractoriness you have cause to fear; remove them into beds apart, and scourge them: but if they are obedient to you, then seek not occasion against them: verily, God is High, Great!"

DAWOOD: "Men have authority over women because God has made the one superior to the other, and because they spend their wealth to maintain them. Good women are obedient. They guard their unseen parts because God has guarded them. As for those from whom you fear disobedience, admonish them and send them to beds apart and beat them. Then if they obey you, take no further action against them. Surely God is high, supreme."

PICKTHALL: "Men are in charge of women, because Allah has made the one of them to excel the other, and because they spend of their property (for the support of women). So good women are the obedient, guarding in secret that which Allah has guarded. As for those from whom you fear rebellion, admonish them and banish them to beds apart, and scourge them. Then if they obey you, seek not a way against them. Lo! Allah is ever High Exalted, Great."

ARBERRY: "Men are the managers of the affairs of women for that God has preferred in bounty one of them over another, and for that they have expended of their property. Righteous women are therefore obedient, guarding the secret for God's guarding. And those you fear may be rebellious admonish; banish them to their couches, and beat them. If they then obey you, look not for any way against them; God is All high, All great."

SHAKIR: Men are the maintainers of women because Allah has made some of them to excel others and because they spend out of their property; the good women are therefore obedient, guarding the unseen as Allah has guarded; and (as to) those on whose part you fear desertion, admonish them, and leave them alone in their sleeping places and beat them; then if they obey you, do not seek a way against them; surely Allah is High, Great.

ALI: "Men are the protectors and maintainers of women, because Allah has given the one more (strength) than the other, and because they support them from their means. Therefore the righteous women are devoutly obedient, and guard in (the husband's) absence what Allah would have them guard. As to those women on whom part you fear disloyalty and ill conduct, admonish them (first), (next), refuse to share their beds, (and last) beat them (lightly); but if they return to obedience, seek not against them means (of annoyance) for Allah is Most High, Great (above you all).

Women in Islam

Women in Islam are appreciated and highly respected, opposite to a lot of misleading and incorrect information that are widely spread among non-Muslims.

Qur'an has highlighted the fact that men and women are equal in the sight of God. According to the teachings of Islam, the only thing that distinguishes people in the sight of God is their level of God-consciousness and being pious. Moreover, the Islamic Law has guaranteed rights to women over 1400 years ago, whereas women in Western societies are now struggling to obtain their rights.

For example, Islam considers the woman a full-person, the spiritual equal of a male. Also, according to the Islamic Law, women have the right to own property, operate a business and receive equal pay for equal work. The woman in Islam has total control of her wealth, she cannot be married against her will.

Moreover, the woman in Islam has the right to inherit property and has the right to get divorced if she doesn't get good treatment from her husband, and can no longer stand her life with him (yet she has to have a good reason). Also, Islam does not look down on women nor consider them an "evil temptress", and thus does not blame women for the "original sin". Women in Islam participate in all forms of worship same like men. Actually, the rights that Islam gave to women over 1400 years ago were almost unheard of in the West until the 1900's.

Fifty years ago, women in Western societies could not buy a house or a car without the signature of the father or the husband! Islam gives great respect to women and their vital role in society. Also, it is noteworthy that the Prophet Muhammad's mission stopped many of the vicious practices in regards to women that were present in the society of his time. For example, the Qur'an put an end to the pagan Arab practice of killing their baby daughters when they were born.

If women in the Muslim World today don't get their rights, it is not because Islam did not grant them their rights, but because of some alien traditions prevailing in many places that have come to overshadow the teachings of Islam, either through ignorance or through the impact of colonisation.

The Islam's respect to the women is crowned with the Hijab, the veil, considered by a lot of anti-Muslims a symbol of women's oppression and servitude. God ordered Muslim women to wear the veil (to cover the whole of their body except their face and their hands) to protect them.

The Qur'an makes it clear through many verses that the veil obligatory and not an option for Muslim women (as some misleading information state).

"O Prophet! Tell your wives and daughters and the women of the believers to draw their cloaks (jalabib) close round them (when they go abroad)..."

The Qur'an also shows how essential the veil is for modesty. Modesty is prescribed to protect women from molestation. Thus, the only purpose of the veil in Islam is protection. The Islamic veil is not a sign of man's authority over the woman, nor is it a sign of the woman's subjection to the man, on the contrary it shows respect and care for the woman.

Concubines - how sick!!

Islam admits that man has the right to possess concubines along with his wife, or wives, to fulfil his sexual needs. Islam presents a number of women that a Muslim man cannot marry, but it excludes "the ones under the control of one's right hand" from this list: "Forbidden to you [in marriage] are your mothers and [own] daughters, your sisters, your aunts paternal and maternal, your brother's daughters, your sister's ... and [already] wedded women, save what your right hands own. So God prescribes for you. Lawful for you, beyond all that, is that you may seek, using your wealth, in wedlock and not in licence. Such wives as you enjoy thereby, give them their wages apportionate; it is no fault in you in your agreeing together, after the due apportionate. God is All-knowing, All-wise" (Sura al-Nisa´ 4:23,24).

We read in the commentary of al-Tabari that "the ones under your [right hand's] control" refer to the women captives that have been separated from their husbands through their captivity, thus becoming lawful for anyone under the control of whose right hand she may fall without any divorce from her first husband.(1) Abu Qulaba narrated, regarding the verse "Nor [should you marry] any [already] married women, except the ones under your [right hand's] control. Every married woman is unlawful for you except any concubine you possessed while she was already married to a husband on the battlefield; she is lawful for you as long as you give her time to be cleansed."(2) He also said, when asked about the meaning of the verse that allows a man to have intercourse with a woman captive even though she is married,(3) that this interpretation is based, no doubt, on the traditions of Muhammad regarding captive women. Abu Sa`id al-Khudri narrated: "On the day of Hunain, the Messenger of God sent a detachment to Awtas. They arrayed for the battle, fought them, conquered them and took some women captives from them. Yet, some of the friends of the Messenger of God were hesitant [to have sex with them] on account of their unbelieving husbands. Then God revealed: 'Nor [should you marry] any [already] married women.' "(4) Some other commentators interpret "except the ones under your [right hand's] control" as being the women of the people of the Book.(5) Al-Tabari comments on the verse: "This should include all the married women, whether their marriage is considered according to us as valid or not, in which case if we marry them we will be committing fornication; except those whom we buy and keep under the control of our right hands as the Book of God permits, or those whom we are allowed to marry according to the same. The women that God permitted us to marry are all free women except those who are forbidden us owing to close family relation or relationship by marriage. Of the concubines, all those we capture from the enemy [are permitted us], except the ones who fall under the category of those who are illegal for us to marry and the married women of the people of the Book. Capturing these women makes them lawful for the captors after they have been purified and after having brought the truth of God out."(6)

Since the relationship between a man and concubines has nothing to do with the issue of marriage, and they theoretically don't have the rights and competence that free women enjoy, we don't find a separate chapter on them in the sources of jurisprudence. This can be explained by the fact that they aren't regarded as persons, but as possessions belonging to their owner, as was the case in the Old Testament.(7) Therefore, they cannot marry their owners legally. Yet, a slave-owner has the right to marry his female slave off without her permission-- he then acts as her owner, not her guardian. As for the children of that slave, they are slaves like their mother, whether their father is a freeman or a slave, since they belong to their mother's owner. It is true that the Sharia allows a Muslim to enjoy [sexual relations with] all his slave women, provided that they be Muslims [or of the people of the Book] and unmarried, yet it emphasises the great difference between this kind of marriage and regular legal marriage. As long as the man remains the owner of the slave woman, they argue, this same right of ownership prevents him from marrying her. If he wants to marry her, he has to pay her a marriage dowry (sadaq). As to children of the slave from her owner, they are as free as the other children of the man in all respects.(8) A man has the right to marry someone else's slave, if she is a believer, as long as her owner approves of it. The Sharia, however, places additional conditions on this sort of marriage, since the children coming from this marriage have no freedom.(9)
