Tucker Carlson, before he was sidelined by Fox, repeatedly endorsed a conspiracy theory about an Arizona man, who may sue for defamation. Legal experts say it would be a viable case.

Of all the distortions and paranoia that Tucker Carlson promoted on his since-canceled Fox News program, one looms large: a conspiracy theory that an Arizona man working as a covert government agent incited the Jan. 6, 2021, assault on the Capitol to sabotage and discredit former President Donald J. Trump and his political movement.

What’s known about the man — a two-time Trump voter named Ray Epps — is that he took part in demonstrations in Washington that day and the night before. He was captured on camera urging a crowd to march with him and enter the Capitol. But at other points, he pleads for calm once it becomes clear the situation is turning violent. He can be seen moving past a line of Capitol Police at the barricades, but never actually goes inside the Capitol...
Yet for more than 18 months, Mr. Carlson insisted that the lack of charges against Mr. Epps could mean only one thing: that he was being protected because he was a secret government agent. There was “no rational explanation,” Mr. Carlson told his audience, why this “mysterious figure” who “helped stage-manage the insurrection” had not been charged.

He repeated Mr. Epps’s name over and over — in nearly 20 episodes — imprinting it on the minds of his viewers.
Mr. Epps was in the Marine Corps but said in his deposition before the Jan. 6 committee that he had otherwise never worked on behalf of any government agency. He and his wife, Robyn, have fled Arizona and are in hiding in another state, having sold their wedding venue business and ranch after receiving death threats from people who appeared to believe the conspiracy theory.

I suppose because there were a lot of demonstrators who didn't actually take part in the insurrection. There's a difference between legally and peacefully demonstrating, and breaking into the Capitol in order to overturn an election. The former is demonstrating, the latter is an insurrection.

He didn't do much that could get him charged, but the right prosecutor might be able to make a case on him. So police might very well have approached him with a deal. "Tell us about the guys around you who committed serious crimes, and maybe we'll just let your case drop."

Happens a lot in cases criminal conspiracies like the insurrection.
 
At any rate, it's not up to Epps to prove he wasn't cooperating with the police. It's up to Fox News to prove he was an agent provocateur. That's probably going to be hard to prove, given the evidence so far. Suing Fox for the crackpot accusations of the clowns they were giving air time seems to be a trend.
 
Oh, and while it's illegal to try to overturn an election by violence, it's not a crime to advocate it unless one can be shown to have actually incited people to do it...

WaPo said Ray Epps attended "Pro-Trump Rallies" , Rolling Stone said Ray Epps attended "protests" on Jan. 6 , NYT said Ray Epps took part in "demonstrations in Washington " , Fox News Ray Epps "joined the Jan 6 protests " .

Just like that the insurrection is gone , amazing .

The military industrial complex will do anything to stop Trump from interrupting their income. I expect us to be at war in Europe before the 2024 election in the hope that will further frustrate him from getting elected.

The basis of Epp's suit STRATEGICALLY , has nothing to do with the news questioning who he is in connection to the sweetheart no jail time, not even a slap on the wrist treatment he received for cheerleading a conspiracy to storm the capital .
Others given stiff prison sentences for not doing anything close to that.
Which by the way News agencies, should always question what is in back of the injustices in applying of our laws.
No doubt that Epp's lawyers were told by our government where they could, and could not go in filing a suit.

The crux of Epp's suit is that Fox "disinformed" him about election fraud and being the poor hapless moron that he is , he was natually led astray to the Capitol like a mindless moth to the flame by the evil Fox network.

There were protests and demonstrations that did not involve attack police, breaking into the Capitol, or attempting to violently overturn the election.

There was a lot of that. I suspect that it wasn't just Epps; I imagine a lot of low-level offenders were called in by the police and asked to provide information on the actual insurrectionists. The vast majority of the people who did what Epps did, were not charged with anything. If the FBI and police did not question them, they were derelict in their duties.

Epps is considering suing Fox for claiming that he was a government agent in the insurrection. It's not hard to figure out. Epps doesn't have to prove he wasn't. Fox has to prove he was.

The basis of Epp's suit STRATEGICALLY , has nothing to do with the news questioning who he is in connection to the sweetheart no jail time, not even a slap on the wrist treatment he received for cheerleading a conspiracy to storm the capital .
If that was an obvious crime, Trump would be in jail now. He might be. But as you know, most people who did what Epps did, weren't arrested at all.

I don't care about Fox News. I dumped them right after the stolen election.

And Trump did not incite the violence at the Capitol. We have the video to prove that. I think we'll see that with the help of the FBI it was a setup. We have the video for that, too.

Nope. But the key is that people are going to prison for their part in the insurrection. Some of them were actually stupid enough to plan the insurrection on social media. Not ever demonstrator or protestor was an insurrectionist, though. Some of them didn't even break any laws. Not surprisingly the insurrectionsts are the ones going to prison.
