Houston police shoot wheelchair-bound amputee threatening people with pen



A Houston police officer shot and killed a schizophrenic, wheelchair-bound double amputee threatening people with a pen at a group home for the mentally ill after authorities said the man advanced on the officer's partner. The shooting occurred early Saturday morning after police responded to a call that resident Brian Claunch was acting aggressively after his caretaker refused to give him a cigarette and a soda, the owner of the home and police said.


"The officers made verbal commands for the suspect to drop whatever he had in his hand, to stay still and to speak with the officers, but the suspect continued to make threats," Jodi Silva, a police spokeswoman, told CNN affiliate KTRK in Houston.
Claunch, who lost an arm and a leg in a train accident, trapped one of the officers with his wheelchair in the corner of a room and attempted to stab the officer with an object that turned out to be a pen.
Officer Matt Marin, "in fear of the safety of his partner and the safety of himself, discharges his duty weapon, striking the suspect," Silva said.


Marin shot Claunch once. He died at the scene, according to investigators.
It was the second time Marin was involved in a shooting. In October 2009, he shot and killed a knife-wielding man who stabbed his girlfriend and a neighbor, according to published reports at the time. Marin joined the Houston Police Department in 2007.
CNN could not reach the department for comment, but Houston police said the officer was placed on administrative leave per policy.
Claunch, who was in his 40s, had been at the Healing Hands home for 18 months, John Garcia, the owner of the group home, told KRTK.


Houston police have not released the identity of the man, though Garcia identified him as Claunch.
Garcia told the Houston Chronicle that Claunch liked to "doodle."
Two days earlier, Garcia gave Claunch a black felt pen to draw. Garcia told the newspaper he did not know if it was that pen or another one that Clauch had in his hand when he was shot.
Garcia said Claunch suffered from schizophrenia and a bipolar disorder.


"He had a temper. He could fly off once in awhile," he told CNN affiliate KHOU.
Claunch was capable of making people in the house feel threatened during an outrage, even though he was confined to a wheelchair, Garcia said.
"Emotionally disturbed individuals, when threatened, are going to react in most instances, excessively," Dr. Ed Reitman, a clinical psychologist, told KRTK.
"This was an incident that didn't have to take place if the individual -- a police officer -- had been trained in dealing with emotionally disturbed individuals."
The Houston Police Department has officers trained to deal with the mentally ill, though the department would not say whether Marin received training, according to KRTK.
 
OK, on this one I'll agree the officer went WAY overboard. :shame
The stupid dumb cop had to know that he was in a mental care home. And that the man was sick. He could have restrained him, he did not have to kill the poor man. I mean the guy was double amputee in a wheelchair. And this the second time that this cop has killed.
 
I make no assumptions about his first shooting. The article didn't say anything negative about it and I'm sure they would have if there had been anything to use there.

However, I think this one incident is enough to question the officer's ability to do that job and/or charge him for a crime.

(CNN) -- Three police officers in Houston, Texas, have been temporarily transferred from patrol duty to desk jobs after claims of assault against the father of Green Bay Packers wide receiver Donald Driver, authorities said Friday.


The fates of police officers Bacilio Guzman, Gilberto Cruz and Matthew Marin will be decided based on the findings of the department's internal affairs division, Police Chief Harold Hurtt said in a statement.

That much poo occurring around a person is a big time red flag
 
I have not known one news story that was correct according to first hand facts. So I make it a practice not to judge based on news accounts, most of which I consider to be gossip. I even am familliar with a headline that won a Pulitizer Prize that did not reflect the contents of the story. So between the gossip and outright propaganda, I stopped taking the paper.

We are told in Titus 3:1 and Roman 13:1-2, Let every soul be subject to the governing authorities. For there is no authority except from God, and the authorities that exist are appointed by God. Therefore, whoever resists the authority resists the ordinance of God, and those who resist will bring judgment on themselves. For rulers are not a terror to good works, but to evil. Do you want to be unafreaid of the authority: do what is good and you will have praise from the same.

So I tread very softly here. We don't necessarily have all the facts. We don't know how much information the police had in this situation. I don't condone what they did. I simply reserve judgement for the sake of Scripture.

I have worked as a nurse with mentally ill people and have friends who are bi-polar or schizophrenic. I am currently partially confined to a wheelchair pending surgery, so I am not unsympathetic to the patient.

(CNN) -- The chief of Houston's police department has asked the FBI to help investigate why an officer shot and killed a disabled man Saturday.
Over the weekend, police said that the wheelchair-bound man was acting aggressively and had tried to stab an officer with a pen.
"The Houston Police Department places the highest value on human life and events like these are tragic and unfortunate for everyone involved," Chief Charles A. McClelland said in a press release Monday afternoon. "All Houston Police Officers receive mandatory crisis intervention training specifically dealing with persons experiencing mental crisis. As we do in all instances of this nature, the



Houston Police Department's Homicide and Internal Affairs Divisions, and the Harris County District Attorneys Office, Civil Rights Division, are investigating this incident."

McClelland vowed to be "open and transparent in all aspects of our response to this tragic event."


"It is my desire to have everyone reserve judgment until all the facts and evidence in this investigation have been gathered," his statement read.
On Saturday officers went to a group home for the mentally ill where Brian Claunch lived. A reported schizophrenic, Claunch was acting aggressively because his caretaker refused to give him a cigarette and a soda, according to police and the facility owner.
Police said Claunch was clutching an object as he advanced on one of the police officers.


"The officers made verbal commands for the suspect to drop whatever he had in his hand, to stay still and to speak with the officers, but the suspect continued to make threats," Jodi Silva, a police spokeswoman, told CNN affiliate KTRK in Houston.
Claunch trapped one officer with his wheelchair in the corner of a room "where he couldn't get out," said a Houston police department representative who declined to be identified.


As he advanced toward the officers, Claunch was "refusing to show his hands," the representative said.
The object turned out to be a pen, which Claunch attempted to stab the cornered officer with, according to police accounts reported in the media, including by KTRK.
The other officer, Matt Marin, was "in fear of the safety of his partner and the safety of himself," Silva said.
Marin shot Claunch in the head, police said.


On Sunday, the unidentified police representative offered more details, saying that, unlike his partner, Marin was not cornered at the time he opened fire.

Marin has been placed on administrative leave per department policy, police said.
The incident was the second shooting involving Marin.

He did not have to shoot this man, the man was sick, and he shot him in the head, he did not try to wound him to stop him. He wanted to kill him.
