Even Jesus recognized, along with the woman that simply being 'with' someone does not constitute a marriage. He did not correct her and say, "Oh, no. You're married alright".
We see that even Jesus saw that a commitment to a steady relationship does not constitute marriage in and of itself.
If she was married to him the only way that marriage would be terminated would be by death or a divorce. Correct?
Common law marriage can only be terminated by death or divorce. And that is the law in all states.
If one does not get a divorce and they remarry they are a bigamist, a criminal, and can go to jail.
In the Bible there was no written marriage license or decree but there was a written Divorce Decree. Common law marriage is just like that.
Why do you think the Supreme Court upholds that to this very day? Because it is the true law of the land, our Constitution.
