Scientific theory is held to a more rigorous standard than a court of law allows. "Beyond a reasonable doubt" in legal terms means "twelve people convinced it's right."
In science, it must go past peer review and make successful predictions.
Nope. Evolutionary theory will be accepted only so long as it is the best available explanation for the facts. If something comes along that fits better, bye-bye, evolutionary theory.
