Joey Visitation Thread

Glad you got to see each other today, and everything sent well. Can't help with the legal side, your laws are probably different than ours.
Talking on the phone is a good idea. Did Joey get your Valentine card ok?
 
Miranda rights being read is only needed in specific types of arrests. Joey didn't qualify.
Police today are experts in knowing when to read them or not.

Tell him to do his time quietly and stay out of trouble and stay away from those who get too much attention.
And when he eventually gets out...become the most boring person in the world. Get a job, pay bills and go to church on Sunday...for a really wild time play video games or go on a picnic with other church couples in the park.

Boring but it keeps you out of jail.
 
Well today's visit went really rather well, the picture machine was broken so unfortunately we couldn't have a picture taken, but as long as it doesn't cost too much money I'm going to get it setup that I can speak with Joey on the phone occasionally. :) Btw, I'm tagging for_his_glory on this one because she seems to be well equipped with legal knowledge. Since Joey originally pleaded no contest because he was afraid that he wasn't going to win this case, is there a time limit for being able to decide whether or not he can withdraw it?



I personally don't think that it's such a good idea since he only has three and a half years left and if he went to trial and he lost he would be in prison for a longer period of time, but I was just curious.

A no-contest plea is not technically a guilty plea and if it was offered as part of a plea bargain he is probably better of leaving it alone. If he were to go to court he could face a longer sentence.

Except for the fact that neither of us are huge church goers (neither one of us are morning people so we go occasionally) that's pretty much what we'll do except for the fact that we won't find it boring,.. for the way I see it is life can be as dull or exciting as you want it to be, and I always choose the latter. :)

From something I heard once that not all arrests are the same.
Like if someone claims someone else did something criminal and the police arrest the accused person then the Miranda rights have to be read...(the police did no investigation and are going off of voluntary information)
But if there is an investigation of a crime by police and evidence points to person or persons then no rights read are needed.

Oh, but no matter what, when, and how an arrest is made, shouldn't the rights be read once that said person is under arrest?

Apparently not.

When a person gets arrested for DUI there are no Miranda rights read.

Even getting a speeding ticket is a type of arrest.

Really?? I didn't know that about the DUI, but I guess I can sort of see what you're saying about the speeding ticket because you still have to show up in court for it.
 
Here in Pennsylvania even if the complainant drops the charges the state still picks them up. I don't understand why if the person decides to change their mind and not have another arrested.
 
Hey everybody, I just wanted to let you all know that I saw Joey today and he was doing really good and we got our picture taken together. :) I don't know why but the metal detector was really acting up today and acting goofy and wouldn't let me in at first. :neutral It probably had something to do with the fact that I had a leftover picture token that I wasn't aware of at first in my pocket though.



Also unfortunately they're changing their policies quite a bit so his mother wasn't able to go in and see him like originally planned. :sad It was because of the fact that she didn't have on the right pair of pants. I always go in jeans and a T-shirt just to be safe but I've learned that a lot of the times white shirts can be see through and if you wear a hoodie you also have to be wearing something underneath it so I just don't see the point anymore since you're allowed to wear jackets as long as you put them in the bin to be checked first. Anyways, at least me and his father still got to see him today but I felt really bad for his mother.
 
She couldn't visit her own son who has been thrown in a cage because she was wearing the wrong pants?. Thats discrimination. Telling people what they can and cannot wear.

The penalty is time, not telling family members what they can and cannot wear.

From tobacco to narcotics and pharmaceuticals.

The "public" is usually pretty guilty of all kinds of stuff... intentionally and often stupidly.

You mean something could be smuggled into pajama pants since they're looser? Also I forgot to mention on here that there are eleven or twelve more visits until we pickup Joey and bring him home! :woot(I accidentally added that to my news thread instead, but it works both ways. :))
 
You would be amazed how much contraband is smuggled in and out of prisons. One prison I use to go into when I was doing Prison ministry cracked down so hard on on the drugs that were being brought in by visitors they would no longer allow me to take my Bible in as it might contain drugs within the paper. I even had to take my shoes off for them to inspect them.

I can understand why certain clothing is not allowed to be worn as access to drugs in prison is greatly on the rise.

It seems more like a violation of rights. Its such a big issue that someone who has been thrown in a cage and has no life might get high.

Most of the public don't realize the drug problem that exist in prisons and how many inmates have OD on drugs while being incarcerated. Not only smuggling drugs in, but materials to make shivs also.
