Joey Visitation Thread

Not much for human rights when you are an inmate. When it's one on one contact during visitation the inmate is stripped searched before and after the visit. I know this for a fact as I use to do prison ministry. They even patted me down and made me take my shoes off before I was allowed to go in. The only thing I was allowed to take in was my Bible as they even searched it. Keys, wallets, purses etc. etc. had to be put in a locker before you were allowed in the visitation room.

I'm not patted down and I don't have to remove my shoes or anything but I can't bring anything back there either except my vendor card and coins for pictures. I can take a jacket with me in the colder weather but it still has to be placed in the bin first.

I'm only giving that of my own experience as some guards are different then others. One time I wasn't even allowed to take my Bible in with me and I was a licensed Evangelist.

Boy do I know that for sure, there was a new guard at the front desk yesterday and Joe's mother had to get another shirt because apparently it was see-through. Although none of us didn't seem to think so, we couldn't see a thing.
 
I used to do prison visiting over here in UK. I was never searched though. I was in charge of a group of visitors. We were asked to go because suicide had risen so high, and we were specialists in that area. The prisoners treated us much better than the officers did. But then we found out that a lot of the officers were suicidal too. It was tough going but we were so glad they had called us in.
 
Oh by the way guys, my mother counted it and the worst case scenario is that I only have fifteen more visits until Joey is home! :woot

Hey guys, I just wanted to let you know that I went to go and see Joey today and he is doing pretty good. :) We were just wondering whether or not anybody knew if doctor's medical records proving one's mental disabilty were permissible in court as well.
 
i think it depends on the state. here where i live, they've got the NGRI (not guilty by reason of insanity) verdicts, which are relatively rare and not fun (Haldol shots? no, thanks!)...then they have GBMI (guilty, but mentally ill) which is like double punishment...and then they have mental illness as "mitigating factors" or something. I think this is a fairly standard set up for much of the nation, except the state hospital is -not- used very frequently (too much $$$).

other states are different. i think most states use their state hospital more frequently, which can be good or bad...bad because the state hospital can sometimes keep people indefinitely, even on relatively minor charges, because they keep people until they're "well," whatever that means. good, sometimes because...now and then, they do help people, not just warehouse and drug them. so there ya go. :)

Thanks but the reason I wanted to know this is because Joey was never read his Miranda rights and he didn't understand that he had the right to remain silent or have the option to leave if he wanted to.
 
If he was never read his Miranda rights that is a case in itself that his lawyer needs to address and could help him get out especially if he is innocent. Medical records could go both ways as it could prove you are incompetent, but also could place one in a mental hospital for observation to see if they can stand trial. Sometimes it's not a win win.

Sorry that I'm just getting back to you about this now Deb but my power was out and I'm sort of sick right now. :sick Anyways, to be perfectly honest with you I'm not sure what all they have tried and what they haven't all I know is that the appeal failed for some strange reason. :sad

Hope you are feeling better today. Maybe that is something you can ask Joey the next time you visit if the lawyer knows that the Miranda rights where not given to him. We'll just keep praying for his release.

Thank you, I am feeling much better today. It's just sinus season for me. I feel a little clogged in the head but other than that so far I'm good. :)
 
Well today's visit went really rather well, the picture machine was broken so unfortunately we couldn't have a picture taken, but as long as it doesn't cost too much money I'm going to get it setup that I can speak with Joey on the phone occasionally. :) Btw, I'm tagging for_his_glory on this one because she seems to be well equipped with legal knowledge. Since Joey originally pleaded no contest because he was afraid that he wasn't going to win this case, is there a time limit for being able to decide whether or not he can withdraw it?



I personally don't think that it's such a good idea since he only has three and a half years left and if he went to trial and he lost he would be in prison for a longer period of time, but I was just curious.
